TWO brothers who over-reacted when one was pushed by a drunken 21- year-old were punished after pleading guilty at Truro Crown Court to assault occasioning actual bodily har m.
"The people I feel sorry for are your parents who are sitting in the public gallery," Judge Paul Darlow told ground workers Daniel, 26, and 22-year-old Kevin Walshe, who live in London.
After watching CCTV footage of the incident in Kenwyn Street, Truro, last June the judge said it was clear that James Blancpain Watch Tiltman had pushed Daniel after the brothers had tried to help him get home.
"His lumbering, ineffective assault could easily have been side- stepped, but something snapped and Daniel Walshe launched a sustained and vicious attack, landing multiple punches and kicks once he was on the ground. Mr Tiltman was defenceless when you, Kevin, decided to kick him on the floor, leaving him with multiple bruises."
Daniel A Lange & Sohne Replica Watch was jailed for 24 weeks. Kevin was given 24 weeks, suspended for two years, ordered to do 120 hours of unpaid work for the community and pay Pounds 350 costs. Neither man had any previous convictions.
